The system that enables the sharing of land, cadastre, and map data produced or archived by the General Directorate of Land and Cadastre with institutions and individuals, facilitating efficient tracking and control of immovable properties, is referred to as TAKPAS. Within the Land and Cadastre Sharing System Module, there are sections for ‘Person Information Query,’ ‘Immovable Information Query,’ and ‘Title Deed Information Query.’ TAKPAS data includes information related to associating immovables with natural and legal persons and displaying the rights associated with them. TAKPAS has been reopened for attorney use as of July 21, 2023. Title searches are an integral part of conducting due diligence for any kind of property transaction.

Reopening Real Estate Registration for Attorney Use

The Land and Cadastre Registration System (TAKPAS) has been reopened for attorney use on July 21, 2023.

TAKPAS is a service established under a protocol signed between the Ministry of Environment, Urbanization and Climate Change of the Republic of Turkey and the Union of Turkish Bar Associations (TBB). It aims to provide individuals and institutions with online access to land and cadastre information. The service, which had been temporarily suspended due to a decision by the Personal Data Protection Board, has now been reopened for use by attorneys. In this regard, the “Regulation on the Processing of Land and Cadastre Data and Transactions to be Conducted in Electronic Environment” was published in the Official Gazette No. 31860 on June 8, 2022, to announce the reopening of the system.

The TAKPAS module can be accessed using the UHAP (National Legal Network Project) username and password, which are integrated into the TBB’s system. Using either individuals’ Republic of Turkey identification numbers or institutions’ tax identification numbers, information about the immovable property registered under their names can be instantly queried.

In Turkey, land registry procedures such as sale, grant, transfer by inheritance, and mortgage take place through land registry directorates only, and real estate ownership may be assigned by an official deed to be signed at the land registry directorates and registration.

It is also possible to sign “agreement for the promise of sale” before the notary public. However, an “agreement for the promise of sale” signed before the notary public or any contract of sale issued outside will only constitute a preliminary agreement that entitles one to request the real estate to be sold. It is not possible to transfer real estate ownership by an agreement for the promise of sale.

With the TAKPAS service, attorneys can efficiently query and obtain printouts of land registration information, owner information, share information, and parcel information on maps for both natural persons and legal entities.

In accordance with Article 13 of the aforementioned Regulation: “Attorneys, as sub-users of the Union of Turkish Bar Associations, can query land information through the TAKPAS interface or internet services related to their duties. Within this scope, attorneys can access information regarding whether the relevant person owns an immovable property (including passive registration information) in the system by scanning the written document (such as a check, promissory note, receivable document, lease contract, execution proceeding letter, etc.) that supports the information they are seeking, adding the date and/or number of the document, and confirming the electronic acceptance statement with an e-signature. In queries conducted by scanning the power of attorney document that supports the attorney’s request, attorneys can enter information into the system regarding which person’s assets are being queried for what purpose, and by confirming the electronic acceptance statement with an e-signature, they can access the information (including passive registration information) or extract a record of the immovable property upon the attorney’s request.”
